Once child support orders have been made by Texas courts, you would think that parents would abide and make child support payments, as court orders are legally binding.  Unfortunately, there are countless cases throughout the state of Texas where parents have failed to make their child support payments or owe back child support.  In these types of cases, the parents who were expecting to receive payments must report delinquencies and consider ways in which child support can be enforced. 

In order to report delinquent child support payments, parents will have to contact Texas’ Child Support Enforcement Agency.  Usually, taking this action will involve a small fee of $25.  The Child Support Enforcement Agency will then inform the delinquent parent of his/her failure to pay child support.  The Agency will then either try to work out a payment schedule with the parent or inform him/her that he/she may have to spend time in jail if he/she does not make ordered child support payments.  Child Support Enforcement Agencies may also suggest several courses of action to collect support payments such as:

Income Withholding -  child support payments are automatically deducted from the parent’s paycheck and paid to the other parent, usually on a month-to-month basis

Contempt of Court – in cases where the parent continually refuses to make child support payments, he/she may be held in contempt of court, which means that he/she will be brought before a judge who will inform him/her that he/she will be placed in jail unless he/she makes regular payments

Jail Time – in cases where a parent has already been held in contempt of court and still refuses to make child support payments, he/she may be sentenced to jail time for failing to pay child support
