In the state of Texas, parents are automatically considered joint conservators of their children.  This means that both parents have equal responsibility when it comes to ensuring that their children’s physical, emotional and mental needs are provided for.  This also means that parents share duties, rights and time spent with their children.  In cases where parents are divorcing or separating, they must address the custodial situation of their children.  When parents cannot come to a mutual decision regarding the custody of their children, the courts will intervene and reward sole conservatorship to one parent or joint conservatorship to both parents.

Texas Parental Visitation

If a parent is not rewarded sole or joint conservatorship, he/she may still be eligible for visitation with his/her child.   In Texas, the law will apply a standard visitation schedule in cases where the children are age 3 and over.  In some cases, the judge presiding over the case may suggest a different type of visitation schedule that accounts for holidays or other special allowances. 

Additionally, in cases where parents have worked together to create a mutual visitation schedule, the judge presiding over the case will most likely go along with that schedule.   In cases where divorce is involved, parents may follow any visitation schedule that is in the best interests of their children, as long as it is mutually agreed upon by each parent.
